The regulations on registration and Doctors' activities in the Clinique Générale-Beaulieu as ordered by the Administration.
Doctors' Licensing and Activities at the Clinique Générale-Beaulieu
In accordance with Article 3 of the Clinic's Articles of Association, the latter "shall be open to Doctors and Surgeons who regularly practise in the Canton of Geneva and who have received explicit authorisation from the Administration to practise at the Clinic."
In order to guarantee the quality of the medical care provided at the Clinic, without prejudice to the independence of the Medical Profession and without as a result assuming responsibility for medical treatment provided on the premises, the Administration ordered the present regulations determining the licence requirements for Medical and especially surgical procedures performed on the Clinic's premises.
I. LICENSING PROCEDURES AND REQUIREMENTS
Article 1
The right to practice at the Clinic shall only be granted to Doctors who have been awarded a Federal Certificate, i.e. have an SMA (Swiss Medical Association) Specialisation. Furthermore, Doctors who wish to practise in the Surgical Unit as an SMA approved Surgeon or other Surgical Specialist, must have held the position of Senior Registrar or assistant registrar, or an equivalent post in an institution recognised by the SMA to obtain the qualification of Specialist.
Article 2
Any Doctor who fulfils the above conditions and wishes to practice at the Clinic may make a request to the Medical Council by providing the following documents :
- A full C.V. and copy of his/her SMA Certificate,
- A list of the medical procedures that s/he expects to perform at the Clinic including, if s/he is a Surgeon, a precise description of the operations to be performed in the capacity of Head Surgeon,
- The names of two licensed Doctors supporting his/her candidature (at least one of which practises in the same specialty) as well as a recommendation from the relevant Group of Specialists,
- The agreement to comply with the terms and conditions of the present regulation as well as the above-mentioned "Guide".
Article 3
Based on the abovementioned documents and any other available information, the Medical Council shall notify the Administration of the relevant candidate's request to be licensed. The decision to grant or refuse the licence application shall be made by the Administration, which will inform the candidate concerned of its decision. The Administration may subject a doctor's licence to specific conditions.
II. RESTRICTION AND SUPERVISION OF MEDICAL PROCEDURES
Article 4
Licensed Doctors are obliged to limit their activities to the fields specified in their SMA speciality. The Medical Council and the Senior Medical Officer shall be authorised to supervise the Surgical Programme in order to verify that this obligation is adhered to and to monitor the progress and the quality of the Medical and Surgical procedures. Within the framework of these supervisory activities, the Medical Council may consult a Specialist in the relevant field.
III. LIMITATION AND REVOCATION OF THE RIGHT TO PRACTISE AT THE GENERALE-BEAULIEU CLINIC
Article 5
Except in the case of a special dispensation granted by the Medical Council, all Surgeons and Anaesthetists shall cease their activities at the Clinic after reaching their 70th birthday.
Article 6
The Administration, may at any time, on notifying the Medical Council, revoke a Doctor's licence, particularly if s/he fails to comply with the provisions under Article 4 above, to adhere to the rules and regulations contained in the abovementioned "Licensed Doctor's Guide" (see Article 2) or fails, on an Administrative and/or Medical level, to comply with the code of conduct, courtesy, etc. that are rightfully expected of a licensed Doctor. Furthermore, the Administration may revoke the licence of a Doctor who only practises periodically at the Clinic.
IV. PREVIOUSLY LICENSED DOCTORS
Article 7
Article 4 and ss of the present regulation shall apply to Doctors licensed prior to the entry into effect of the aforesaid regulation. The right to practise at the Clinic may however not be revoked solely because s/he fails to fulfil the condition stipulated under Article 1, second sentence.
